1. Acceptance of Terms
By creating an account or using Emaily ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use Emaily.
These Terms constitute a legally binding agreement between you and The Email Shop, a company registered in England and Wales (company number 15784321).
If you are using Emaily on behalf of a company or organisation, you represent that you have authority to bind that entity to these Terms.
2. Description of Service
Emaily provides:
- A unified email client supporting Gmail, Outlook, IMAP, and SMTP accounts
- AI-powered email drafting using Voice DNA technology
- Email management features including sending, receiving, and organising messages
- Account management and billing services
We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice. We will not be liable to you or any third party for any such changes.
3. Accounts and Registration
Eligibility
You must be at least 16 years old to create an account. By using Emaily, you confirm you meet this requirement.
Account security
- You are responsible for maintaining the confidentiality of your password
- You must notify us immediately of any unauthorised access to your account
- You are responsible for all activity that occurs under your account
- Do not share your account credentials with others
Accurate information
You agree to provide accurate, current, and complete information during registration and to keep it up to date.
4. Acceptable Use
You agree not to use Emaily to:
- Send spam, unsolicited bulk email, or violate anti-spam laws (CAN-SPAM, GDPR, PECR)
- Harass, threaten, or harm any individual or organisation
- Distribute malware, viruses, or malicious code
- Conduct phishing or impersonation attacks
- Violate any applicable laws or regulations
- Reverse engineer, decompile, or attempt to extract our source code
- Resell or sublicense the Service without our written consent
- Attempt to gain unauthorised access to our systems or other users' accounts
- Use the Service in any way that could damage, overburden, or impair our infrastructure
5. AI Features and Voice DNA
How AI works
Our AI features use large language models to generate email drafts based on your input and, if enabled, your Voice DNA profile. AI-generated content is a suggestion only โ you are responsible for reviewing, editing, and approving any content before sending.
Your responsibilities
- You are solely responsible for all emails sent from your account, whether AI-assisted or not
- Do not use AI features to generate deceptive, illegal, or harmful content
- Do not use AI features to impersonate individuals without their consent
Voice DNA data
Email samples you provide for Voice DNA training are used solely to personalise your AI writing profile. You grant us a limited licence to process this data for this purpose. You can delete your Voice DNA profile at any time from your account settings.
6. Intellectual Property
Your content
You retain full ownership of all emails, data, and content you create or store through Emaily. We claim no intellectual property rights over your content.
Our IP
Emaily, our platform, features, software, and brand assets are owned by The Email Shopand protected by copyright, trademark, and other intellectual property laws. You may not use our name, logo, or branding without prior written consent.
Feedback
If you submit feedback, suggestions, or ideas about Emaily, you grant us a perpetual, royalty-free licence to use that feedback to improve our products without obligation to you.
7. Payment and Billing
- Paid plans are billed monthly or annually as selected at checkout
- All prices are in GBP and include VAT where applicable
- Payments are processed securely by Stripe
- Subscriptions renew automatically unless cancelled before the renewal date
- Annual plans may be eligible for a pro-rated refund within 14 days of purchase
- We reserve the right to change pricing with 30 days' notice
8. Cancellation and Refunds
You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period โ you'll retain access until then.
We offer a 14-day money-back guarantee on all paid plans. To request a refund, contact contact@emaily.uk within 14 days of your first payment.
9. Termination
We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or if we are required to do so by law. We will provide reasonable notice except where immediate action is required to prevent harm.
Upon termination, your right to use the Service ceases immediately. We will delete your data in accordance with our Privacy Policy.
10. Disclaimers and Limitation of Liability
The Service is provided "as is" without warranties of any kind. To the maximum extent permitted by law, The Email Shop disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
The Email Shop's total liability to you for any claim arising from these Terms or your use of the Service shall not exceed the greater of (a) ยฃ100 or (b) the amount you paid to us in the 12 months preceding the claim.
Nothing in these Terms limits our liability for death or personal injury caused by negligence, fraud, or any liability that cannot be limited by English law.
11. Governing Law and Disputes
These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the English courts, except where you are a consumer in another jurisdiction and local law provides additional protections.
12. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by email or in-app notification at least 14 days before they take effect. Continued use of Emaily after changes take effect constitutes acceptance of the updated Terms.
